It is vital that the Sellers' Disclosure be accurate and discloses any defects in the systems and equipment. The Buyer signs the Sellers' Disclosure, acknowledging acceptance of those defects.

The Buyer may hire professional inspectors to view and inspect all aspects of the property. They will include a general inspection of the major systems and equipment (electrical, plumbing, heating, cooling, appliances). They may also choose to inspect for lead base paint in properties older than 1978, termites and other wood destroying organisms, radon gas, and mold. House inspections may include the pool, roof, and seawalls.

The Buyer will inform you of any items found to be unsatisfactory or not in working condition that are “seller responsibility”. The Buyer will let you know if they prefer a credit at closing or to have the defects corrected prior to closing. The sales contract may specify a percentage of the sales price that the Seller is responsible for.

The inspection report may also include items which are cosmetic or routine maintenance in nature, which are not Seller responsibility, but provide the Buyer with a wonderful “handyman list”.
